issue on appeal was whether the appellant's lottery
winnings that were paid once per year are to be considered
monthly income in determining a Patient's Paid Amount (PPA);
whether the gross or net lottery payment is countable and
whether the lottery payment is an inaccessible asset.

JEFFREY
A. BLOOM SUBMITTED a Superior Court decision that he and
Steven Cohen brought under 30A. Jeff commented that
"Having understood realty trusts, Judge Lopez
followed the Leger decision on the issue of realty
trust. Following the principles of fairness and
interpreting the DMA's authorizing statute, Judge Lopez
help that the Commissioner may not order rehearing when he
or she disagrees with the result, but only where there was
some procedural defect in the fair hearing which would
undermine its reliability."

I have just
returned from our Chapter's board retreat, which
took place in Sandwich from 9:00 to 4:00 today.
Organizing the board retreat is the responsibility
of the Chapter's president elect. It serves to
set the agenda for the term of the president elect,
which begins in January. If this year's
retreat is predictive of Kathy Nealon's presidency,
it will be a very full and productive year.

to communication technology to developing strategies
to strengthen our chapter's presence on the national

Founded in 1992, the Massachusetts Chapter of the
National Academy of Elder Law Attorneys has grown to
include more than 130 elder law attorneys.
Membership in the chapter provides NAELA members the
opportunity to network with attorneys and other
related professionals regarding Massachusetts issues
affecting the elderly in our state. The
Chapter has participated in the public policy arena
by drafting and promoting legislation relative to
the Medicaid transfer of assets rules, spousal
impoverishment, and estate recovery and by assisting
in the development of regulations relative to
nursing homes, Medicaid, and estate recovery.
